A leave of absence agreement is a legal document of all the terms and conditions of an employee for leaving the business or workplace for a specific period. The agreement is arranged between an employee and his employer to take an absence from work to attend to different matters. This is an official document and can be used in a court of law.

Terms and conditions of the following agreement are given below,

  1. This agreement shall commence from date (__/__/__) and should be followed.
  2. Employee is responsible for providing a valid reason for the leave of absence.
  3. It is the responsibility of employee to provide employer with regular updates of his whereabouts.
  4. Employer can ask for bills, receipts and other proofs to fact check the reason behind absence.
  5. Employer is entitled to fact check the reason of absence from work.
  6. If employee lies about his reasons and the situation is different than company is allowed to take strict actions against him.
  7. The period for absence is 6 months.
  8. Employee will be allowed to continue the job after 6 months.
  9. The leave of absence shall start on date (__/__/__) and end on date (__/__/__).
  10. Catching up on work after the 6 months period will be the job of employee and he will do this without any help from the company.
  11. Employer is responsible for paying full salary of the employee for this period.
  12. If employee is unable to keep up with work after the leave of absence then his termination can be served.
  13. Employee will be entitled to serious ramifications in case of lying about leave of absence.
  14. All the clients of the employee will be directed to him for assistance during this period
  15. Employee is responsible for providing assistance on call.
  16. Rank of the employee will remain same after the absence period.
  17. It is the responsibility of employee to complete all pending tasks of 6 months immediately.
  18. If employee do not provide satisfactory services after the absence period, he may be served with termination letter instead of warnings letter.
  19. If the employer hires someone during leave of absence, then employee is allowed to take legal actions against the employer.
  20. This agreement is prepared in the presence of legal counsels from both parties.
  21. Presence of legal counsels ensures that both parties are treated fairly.
  22. This agreement will be signed in the presence of two credible witnesses provided by both employee and employer.
